TERMS OF USE

The present website accessible at the address www.thewhyconnection.com (hereinafter the "Site") is published by Mr Zachary Davis WYMAN, individual entrepreneur, registered with the RCS of Paris under the number 503 369 118 and whose registered office is located at 2, Rue Lord Byron, 75008 Paris (hereinafter "The Why Connection").

The purpose of these terms and conditions of the Site (hereinafter "T&C") is to define the conditions of access and use of the Site as well as the rights and obligations when using the Site by any person visiting the Site (hereinafter "Users").

Article 1: Application and Enforceability of the T&C

The use of the Site implies the full and unreserved acceptance of these T&C, which include the privacy policy available here, which the User declares to have read and understood in their entirety. The User must not continue to consult the Site if he/she disagrees with all or part of the T&C.

The present T&C are available and accessible online via the Site. They come into effect on the date they are put online and are enforceable throughout the period of use of the Site and until new T&C replace them. The present T&C cancel and replace any previous version.

The Why Connection reserves the right to modify these T&C at any time, these modifications shall not give rise to any right to compensation, which the User expressly accepts. The User is invited to consult the T&C regularly to ensure that his use is in accordance with the conditions set out in the latest applicable T&C.

Article 2: Site Access

To access the Site, the User must have a computer, a tablet or a smartphone with internet access. The costs associated with connecting to the Site and using it, invoiced by the access providers or telephone operators, shall be borne exclusively by the Users. The User must ensure that his computer and transmission resources are in good working order and up to date in order to benefit from the features of the Site, and to cope with their evolution.

The Why Connection reserves the right, without prior notice or compensation, to suspend or close the Site, in particular to carry out maintenance operations or permanently.

Article 3: Security

The User commits to not disrupt the proper functioning of this system or to carry out any operation likely to lead to fraudulent access. In particular, he/she shall not introduce any virus or any other technology harmful to the Site. If The Why Connection has legitimate reasons to believe that the security of the Site is violated or that it is misused due to an unauthorized use of the Site, The Why Connection may proceed to temporarily suspend access to the Site in order to preserve the integrity of the Site and the data if it seems appropriate.

The Why Connection makes its best efforts, in accordance with the rules of the art, to secure the Site in view of the complexity of the Internet. It cannot guarantee absolute security. The User declares that he/she accepts and acknowledges the characteristics, limits and hazards of the Internet. The User is invited to report without delay to The Why Connection any difficulty that he/she may encounter when using the Site.

The User agrees to take all appropriate measures to protect his/her own data and/or software from contamination by viruses or other anomalies of any kind on the Internet network.

Article 4 - Intellectual Property

The Site, the brands, logos and any other distinctive sign of The Why Connection and/or its partners, as well as the contents of the Site (i.e., any text, video, photograph or any other information in any format and of any nature whatsoever appearing on the Site) and without this list being exhaustive, are the exclusive property of The Why Connection and/or its partners and/or third parties and are likely to be the subject of protection, by copyright, trademark law, design law, patent law or any other intellectual property right. The T&C do not entail any transfer of property of any kind to the User.

Therefore, it is forbidden to copy, modify, reproduce, distribute, publish, integrate on any medium whatsoever, adapt, transfer or assign, license, sub-license, pledge, transmit in any other way the elements of the Site or reverse engineer or use any other method to try to access the source codes of the Site, without the express permission of The Why Connection or the owner of the rights.

The Why Connection grants the User only a right of access to the Site, on a non-exclusive, personal, non-transferable basis and for strictly private use that complies with the provisions of these T&C.

Article 5 - Liability

The User is responsible for the use of the Service and their actions on the Site. The User commits to use the Site in a loyal manner, in compliance with these T&C and with the applicable laws and regulations, in particular the laws relating to intellectual property and the regulations on personal data.

The User commits to use the Site and the information to which they may have access only under the conditions defined by The Why Connection and for a purpose that complies with public order, good morals and the rights of third parties. The Why Connection cannot guarantee the accuracy and completeness of the information published on its Site. In this respect, the User understands and acknowledges that the information provided on the Site or by other sources available on the Internet through hyperlinks is provided for information purposes only and does not constitute legal advice or consultation for which The Why Connection may be held liable.

More generally, The Why Connection is only bound by an obligation of means with regard to the implementation of the Site. In this respect, the information appearing on the Site may not be considered as having any contractual value whatsoever, and the User is invited to contact The Why Connection for any request for information or quotation.

Article 6 - Personal Data

As part of the use of the Site by the User, The Why Connection may process the User's personal data under the conditions defined by the Privacy Policy available here, which forms an integral part of these T&C.

Article 7 - Confidentiality

Any information transmitted or collected by The Why Connection when using the Site is considered confidential by nature.

This provision does not prevent The Why Connection from communicating in order to comply with the laws and regulations in force and or any judicial or administrative requisition or request, to protect itself or its Users or any other person.

All confidential information and their possible reproductions are and will remain the full and complete property of the party who will have communicated them. The owner of the confidential information reserves all industrial or intellectual property rights relating thereto.

Article 8: Miscellaneous

The fact that The Why Connection does not take advantage of these T&C at a given moment cannot be interpreted as a renunciation to take advantage of any of the clauses of these T&C at a later date.

If one or more of the stipulations herein are held to be invalid or declared as such in application of a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.

Article 9 - Applicable Law and Jurisdiction

These T&C are governed by French law.

In accordance with Articles L.611-1 et seq. of the Consumer Code, the User is offered the possibility of using the services of a mediator free of charge for the purpose of amicable resolution in the event of a dispute arising between them and The Why Connection, after having first attempted to resolve the dispute amicably directly with The Why Connection. The Why Connection is affiliated to the National Chamber of Mediation Practitioners (CNPM).

In the absence of an amicable agreement, the User may take legal action for any dispute on which he/she disagrees and is invited to immediately stop all use of the Site.
